The Northwest Portland Area Indian Health Board (NPAIHB) is pleased to provide you with this site for your personal education. The NPAIHB believes that teens and young adults should have access to health information and services that allow them to take personal responsibility for their health. User Submissions
Users may submit textual, graphic, audio and video content (Who R You Submissions - http://www.wernative.org/Whoru.aspx). User submissions include, without limitation, comments to pages on the website, and text, photos, artwork, videos and digital stories posted by users. User Submissions may be reviewed by We R Native staff prior to posting to the site. This review may result in a delay before the User Submission appears on the website. The amount of time between the submission and review by NPAIHB staff may vary. Users should not expect an immediate response, and NPAIHB does not guarantee that any User Submission will be immediately reviewed.

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and warrant that you own or have all of the necessary licenses, rights, consents, and permissions (including, without limitation, permission from any third parties depicted in your User Submission to use their name, image, likeness, sound or biographical material) to use, and authorize NPAIHB to use any and all User Submissions in the manner contemplated by the Site and these Terms of Use. You retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to the Site, you hereby grant NPAIHB a worldwide, non-exclusive, royalty-free, sublicenseable, transferable, perpetual and irrevocable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Site and NPAIHB (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Site a non-exclusive license to access your User Submissions through the Site, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Site under these Terms of Use.

You agree you will not submit, post or upload any material to the Site that that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant NPAIHB all of the license rights granted herein.

You agree that you will not submit, post or upload any material to the Site that incites other users to commit self-harm or harm against others. You agree that you will not submit, post or upload any material to the Site that:

• is inappropriate, offensive or contrary to any applicable laws or standards. This includes, without limitation, material that is obscene or indecent, depicts violence, sexual activity, or pornography; or contains instructions in crime or drug use; or defames, harasses, menaces, threatens, abuses, offends, bullies or embarrasses any person.
• infringes the copyright, moral rights, confidentiality rights or intellectual property rights of any person, for example, by reproducing songs, poems, articles, logos, trademarks, pictures, photos, music or other material that is not owned by you (or which you do not have a license to reproduce on the Site);
• infringes any of our rights or the rights of any third person including privacy rights;
• breaches applicable local, national, or international laws, regulations, standards or codes as enacted, modified or updated from time to time;
• impersonates any person or suggests a connection to a group or organization that is misleading; • advocates the use of force or violence towards any person; • encourages, endorses, approves or recommends the performance of dangerous or illegal acts; or
• contains a virus or other code that has harmful or destructive properties.

We may, at any time, without notice to you, filter, remove or refuse to post or link to files, content or other material that we consider in our sole discretion to be in breach of the Terms of Use. If you observe that another user has submitted material that you believe violates these Terms of Use, you may report your concerns to us at native@npaihb.org. If we determine, in our sole discretion, that the material is in violation of the Terms of Use, the material will be removed from the website.

The We R Native logo and URL (www.wernative.org) are owned and trademarked by the NPAIHB. All rights reserved. If you find our materials useful, you may download, print, or send copies to others, so long as the source is cited and it is used for nonprofit purposes. It is expressly prohibited to reprint or electronically reproduce any text, document, graphic, or audio-visual material from We R Native for commercial purposes without written permission. 1. Privacy policy
The weRnative website located at www.wernative.org, including all of its sub sites and related services (collectively the “Site”) is operated by the Northwest Portland Area Indian Health Board (“NPAIHB”). NPAIHB respects and is committed to maintaining the privacy of all visitors to this Site. Your use of this Site indicates that you accept this Privacy Policy, and consent to the collection and use by us of any information that personally identifies you (“Personal Information”) according to the terms below, and to the Site’s Terms of Use available here. NPAIHB reserves the right to modify the content, nature and accessibility of the Site, in which case the Privacy Policy will continue to apply.

NPAIHB may revise this Privacy Policy at any time by placing a notice on the Site advising that the Privacy Policy has changed. You will be deemed to have accepted and agreed to the revised Privacy Policy if you continue to use the Site after notice of the revised Privacy Policy has been placed on the Site. If revisions to the Privacy Policy are unacceptable to you or cause you to no longer be in compliance with the Privacy Policy, you must cease using the Site.

2. Collection of Personal Information
You can browse the Site without telling us who you are or revealing any other Personal Information. In some cases, we may ask for your Personal Information in order to provide the services you request or to help improve the Site. We will only collect Personal Information which you voluntarily provide to us when using the Site, including without limitation:

If you choose to contribute any “User Submissions”, as defined in the Site’s Terms of Use, we will collect your IP address and you may also be required to submit your name, email address, mailing address, Tribal affiliation, or other information.

If you choose to voluntarily complete one of the Site’s surveys, we may ask you for certain information to help us understand who is using the Site, including your age, gender, race, ethnicity, satisfaction with the Site, year in school, employment status, etc. IP addresses of survey respondents may be collected, but NPAIHB will not share such information with any third parties except for NPAIHB’s affiliated entities, contracted service providers or professional advisors.

3. Use of Personal Information
NPAIHB uses Personal Information to fulfill and process the requests of users, including to provide technical support or account maintenance. We may also use this information to provide you with updated information on new projects commenced by NPAIHB, to alert you to special events organized by NPAIHB, to let you know when new content has been added to the site, and to conduct research, surveys or engage in other marketing purposes.

Subject to the exceptions listed below, Personal Information will only be accessed by NPAIHB management and personnel, NPAIHB’s affiliated entities including Native Youth Designs for gear requests, and NPAIHB’s contracted service providers and professional advisors, all of whom are bound by this Privacy Policy, and we will not give your personal information to advertisers and other organizations without your express consent.

In the following circumstances, NPAIHB may disclose your Personal Information without your consent:
if we believe there is a serious and imminent threat to the life, health or safety of yourself or another person (for example, if we learn that a person is suffering abuse or has made statements of an intent to commit self-harm or harm another) to investigate or report on activity which we believe on reasonable grounds to be unlawful

if disclosure is required or authorized by law (for example, in response to a subpoena or where a regulatory authority has the power to request the provision of certain records or information)

if disclosure is reasonably necessary to enable an enforcement body to perform its functions, for example: the prevention, detection, investigation, prosecution or punishment of criminal offences; and the preparation for, or conduct of, proceedings before any court or tribunal, or implementation of the orders of a court or tribunal.

If NPAIHB deems necessary in its sole discretion to protect its legal and legitimate business interests.

You acknowledge that NPAIHB’s right to disclose Personal Information under the Privacy Policy may involve disclosure to entities located outside the United States. Where NPAIHB is required or authorized to disclose your Personal Information, you consent to the disclosure of your Personal Information to foreign entities.

4. Sharing Personal Information
You may have the option to publicly post or otherwise disclose your Personal Information in certain portions of the Site. Any information that is posted or otherwise disclosed in these areas becomes public information. You post such Personal Information on the Site at your own risk. Please exercise caution when deciding to disclose Personal Information to others. NPAIHB cannot control the actions of other users of the Site with whom you may choose to share Personal Information. Therefore, we cannot and do not guarantee that Personal Information that you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. Any improper collection or misuse of Personal Information provided on the Site is a violation of the Terms of Use.

5. Security of information

NPAIHB will take reasonable steps to ensure your Personal Information is protected from modification, misuse, disclosure, loss and unauthorized access. While NPAIHB will take reasonable precautions against potential breaches of your Personal Information, no website or Internet transmission is completely secure. Consequently, NPAIHB cannot, and does not, guarantee that unauthorized access, hacking, data loss, disclosure, misuse, modification or any other breaches will not occur. NPAIHB urges you to take steps to keep your personal information safe by memorizing your password or keeping it in a safe place, and logging out of your online user account and closing your web browser after you are finished using the Site.

6. Cookies and session information
Cookies are pieces of information that a site sends to your computer’s hard disk when you access information on that site. Each time you use your computer to access the same site, the information that was previously received is sent back to the site by your browser. We use session ID cookies to confirm that users are logged in. These cookies terminate once you close the browser. Cookies do not identify individual users. However, when you visit the Site, our servers may record information about your usage, the time of your visit, its duration, the pages you visit and style settings. If you do not agree to the use of cookies, you can set the preferences on your browser to remove all cookies and reject cookies in the future.

NPAIHB may use information to publish aggregate statistics about usage, registration, traffic patterns and other related site information that does not personally identify users. This is important to ensure that our content and services continue to meet the general needs of our users. IP addresses may be collected, but NPAIHB will not share such information with any third parties except for NPAIHB’s affiliated entities, and contracted service providers or professional advisors.

7. Third-party links
This Privacy Policy applies only to information collected by NPAIHB through the Site. From time to time, the Site may provide links to third-party websites. This Privacy Policy does not apply to third-party websites, whether or not the Site provides a link to such websites. You are encouraged to review the policies of any and all such websites carefully, as your rights will be governed by those websites’ respective privacy policies. Alternatively, there may be unauthorized third-party websites that may link to our Site without our knowledge or control. NPAIHB (a) is not responsible for the content of any third-party websites, (b) expressly disclaims any statements or assertions made on any third-party websites, and (c) denies all liability associated with your use of, and the content on, any third-party websites.

8. Minors and Children Under Age 13
We recommend that minors 13 years of age or older ask their parents for permission before sending any Personal Information to anyone over the Internet.

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register on the Site or send any Personal Information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any Personal Information to NPAIHB or on the Site. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information. If you believe that we might have any information from or about a child under 13, please contact us.

9. Access to information
Please contact us if you believe that the Personal Information that you have provided to us is not up-to-date, complete or accurate. You have the right to request the correction of any information which relates to you and is inaccurate. If you would like us to delete any Personal Information that you have disclosed only to us as part of registering or subscribing with the Site, please let us know and we will take reasonable steps to delete it unless we are required by law to keep it. However, if you publicly disclose your Personal Information on the Site, (e.g., you include Personal Information in a comment to an article on the Site or in a User Submission), such information becomes public information. We may not be able to remove such publicly disclosed Personal Information. Please be aware of this before you choose to publicly disclose your Personal Information on the Site.
